629 Flat Shoals Avenue
« on: June 27, 2011, 08:49 am »
Walking the dog the other day and noticed the City of Atlanta had tacked up an "in rem" condemnation hearing notice on the front of this property (the fire damaged green house with the brick wall in the front yard).  According to the letter, the hearing was set for late July (the 28th, i think).  I thought I had seen somewhere on the buzz that someone had purchased this house and was going to renovate it...

Work had started and they filled at least one dumpster. Also put up the temporary electric pole.  Haven't seen any work for 2 weeks or so.
I don't have kids.  I've never figured out what they're for.

on June 13, Maura Mitzner representing herself as Greenstone Design/Red Oak Investors of the 1100 block of Moreland Place applied for a building permit for "REAR DECK ADDITION INTERIOR RENOVATION & ALTERATIONS FRONT PORCH ADDITION, CAR PORCH ADDITION"

On the 23rd (this past Thursday) the applicant was notified by the plan reviewer that modifications needed to me made to the plans.

This is a similar situation to the house on Gresham & Ormewood, where a new owner came in at the 11th hour and stopped the In Rem demolition process.  I suppose this owner (and probably Code Enforcement) will state at this hearing that progress is being made on renovation of the property.

The owner of record is still listed as Joyce Nottingham, who apparently bought it in November 2009.  There's not a condemnation action pending that I can find in Dekalb Superior, but she's got three suits against various lenders pending, all with requests for a restraining order, so I'm guessing that she's trying to prevent multiple foreclosures by those lenders.

The notice I saw was for a hearing in the City of Atlanta Municipal Court.

That's a bit strange.  I always thought condemnation actions were exclusive jurisdiction of the superior court since it involved title to land.  Municipal Court records aren't online though.

I live in one of Maura's renos and we quite like it. The benefit of her being on that property is that any issues will likely be resolved quickly, the work will get done, and the house will be back on the market in a good amount of time.

This.  She does high quality work in a timely manner, and as a result has been one of the few renovators who has consistently been able to run a successful business throughout the recession.

I do many closings for Maura and I have never heard a complaint from a homeowner on the quality of her renovations.  She is a great person to work with and I hope the plans get resolved quickly.

The In Rem process is not a condemnation (taking) of land.  It is a code enforcement case where the city would demolish the house and impose a lien for the cost of demolition.

Thanks for clarifying.
