Let me offer a different point of view -  How many of you bank at Suntrust?  I do.  I have been asking Suntrust for over a year to enforce the bank parking only signs.  I have made attempts many times to park and do my banking only to find no spot available and.....go in the bank and find I am the only one in there.  If they boot the assigned or signed parking spaces, I am all for it.  I even asked the manager could her employees be parking there and she replied no.  I agree that the spaces by the drive through are up for grabs or should be to promote great businesses like Joe's.  But if it says bank parking then they should enforce it so that what takes 15 minutes to transact should be in and out.

I bank at SunTrust. I typically park outside of the Flatiron and walk across the street. But again it's the question of reserving spaces needed for the business vs. keeping everybody out of your lot.

But you raise a good question - if you're the only one who is ever in the bank when you go there, how many spaces to they really need to reserve?

I bank at Suntrust as well -- if I'm banking, I will park in one of their reserved spots.  If not, I don't.  Have generally not found it to be a problem when I've needed to stop by there during the day.  And, as a practical matter, these things are terribly difficult to enforce.  Someone could park there, legitimately run another errand or grab coffee, etc. -- and does the bank really want to mistakenly boot a real customer for an infraction.  I don't think there's gonna be a huge desire to do that.

Then your concern is just inapplicable after-hours.

Ultimately though, if the owner wants to enforce tenant reserved parking, if properly noticed, they have a right to do so.  But it's definitely very anti-community and would have a negative impact on surrounding businesses.

Presumably the tenants could have some voice re: enforcement on the lot tied to the building. The other parcel (and I don't believe it's signed in any fashion -- and, doesn't it also contain the Suntrust drive-through -- might be more open game for a new owner trying to maximize the asset; ST might have a relationship, but not sure how much of an ally they would be unless forced to do so.  I would doubt any space there is dedicated for the drive-through.  So, it could be closed off and parking prohibited, while the owner tries to find someone in EAV who will lease the lot -- same situation as with the adjacent Earthshaking Music lot.

Just a note about the immediate lot: there's more than just Suntrust in that building. The upstairs studio does a lot of after-business-hours stuff where there might legitimately be 30 people needing to park. I wonder if something happened to one of their patrons and that's what spurred this, or if someone's really just being an ass.

I snorted when I saw that. Seriously? Craigslist? At least it wasn't listed under casual encounters or something equally shady and touted as a place know for its "discretion".

And I'd like to go on record as saying if I got suddenly rich I wouldn't buy and renovate the Madison, I'd buy this building and turn it into one heck of a 10,000-sf urban residence.

Is the parking lot a separate parcel?  I'm now confused as to where the booting is going to take place, but if it's a different parcel, I can probably get the owner from the parcel number or address.

From my former paralegal (who is looking for a new job if you need an excellent paralegal):

"It's the same DUP [Deed Under Power].  The legal description for Parcel Two includes both 495 and 487 Haas.  The foreclosure that occurred in November was rescinded by an affidavit (the foreclosure ad had an error that caused the DUP to be ineffectual)."

So, Community Bank of the South is the current owner of both Haas lots and is ultimately responsible for any booting that occurs.
