What's that plant?

Anyone know what this is? Is it a type of Smilax?

Privit. PRivit is berrying heavily anywhere right now. I suggest everyone cut off the berries soon, because it is very invasive and birds eat the berries them poop them out. If you don't feel you need this plant, I'd get rid of it, it also spreads underground and colonizes quickly choking out  native plants.

Thanks FL! I figured you'd have the inside track. I did some pruning today, will need to get a stepladder to do much more.

Ok, someone just gave me 6 landscaping plants that look Kiiiiiiinda like privet, but have different leaves (slightly different shape, much more leathery leaves).

The berries are same color/size.... but the inside seed/pulp looks different. 

I have a ton of privet, and its not the same.

My friend saved them from being sent to a dumpster.  I need to know what they are, so I can decide to plant them in shade or sun.
Unfortunately the tag is gone (these are landscaping size bucket plants).

He mentioned something about the Hawthorne family, but that doesn't seem to match.
Anybody have  a guess? I will try to post a picture

They could be leather leaf privit. There are many kinds with various leaves. The leather leaf is often listed as "non-invasive" however if it berries like crazy, it will be.
What you have is probably called "indian hawthorne" which is a typical southern landscaping plant and is non-invasive. Easy to grow, sun-part sun.
