770 Shadowridge (again) this time for realz

The former Beulah Church of Christ Holiness USA site is under contract and will close this week.   The developer has not contacted the neighborhood group that is "watching" this property.  Since the site is currently being cleared, calls to the city planning department with concerns about the stream buffer and the diameter of trees being removed have resulted in "no trespassing" signs being posted.

Looks like the new property owner is gonna play hardball with the neighbors.

Then the developers need to be acutely aware that they drew "first blood"!
They will end up rueing the day they ignored the neighbors!

Updates! 

"Robert Patterson of City Life Development Partners has contacted our neighbor xxxxxx  http://citylifedevelopmentpartners.com/ He says he has a contract to buy the 770 Shadowridge property and has a due diligence period until some time in February.  He is wanting to meet with the concerned neighbors of the property before his due diligence time is up."

It appears that CityLife Development Partners has not yet built a housing development.  Great learning opportunity here!

We're convinced they will ask for a variance to the stream buffer so they can build more houses.

I would guess so also. I would like to see a plan. I don't mind a variance if it is tasteful. Last I was near the stream it was pretty nasty with trash, but that was two years ago. I think development would actually make it cleaner.

Here's the latest development-  *chuckle*  (sounds like these guys mean business.)

"Dear Neighbors,
 
In the last update we reported that a new buyer had acquired an option on 770 Shadowridge,  At the time, we did not know who the buyer was.  Since that update, the buyer has contacted our neighbor Bill Gould.  The buyer is Heritage Capitol Partners.  http://www.heritagecapitolpartners.com/index.html, the principals of which are all members of the Ashkouti family.  Mr. Joseph Ashkouti is the lead Heritage partner for this project.
 
Last Thursday the same small group that has met with the previous potential developers, met with Mr. Ashkouti.  The developer brought along his lawyer, David Patton, a consultant, Brian McCarty, and a financial analyst with Heritage Capitol Partners.  Brian McCarty was also a consultant to the immediately preceding potential developer.
 
At the meeting with Mr. Ashkouti, we made it clear that we were not empowered to negotiate with him, but were gathering information about his proposed development to take back to the larger group of neighbors.
 
We will report on, and discuss, Heritage Capitol Partners proposed development at a meeting next Wednesday, June 14th at Branan Towers. The primary plan the developer has proposed calls for 21 single family houses and re-zoning of the land parcel from R-4 to MR-1. (MR-1 is multi-family housing with a minimum lot size of 2,000 sq/ft as compared to 9,000 sq/ft in R-4). 
 
We will meet at Branan Towers at 1200 Glenwood in the same room that the East Atlanta Community Association uses on the entry level of the building.
 
We will also present updates on our communications with the city regarding its potential interest in purchase of the land and preservation of the tree canopy and steam with funds from the city Tree Recompense Fund.

From what I hear, the developers are planning a major move to get this approved at the NPU-W LUZ meeting Monday July 10th at 7:00 at The Village Church next to Village Fitness and ALL who want to be heard about the future of Ormewood Forest need to attend!

"East Atlanta and our neighbors certainly haven't become a coveted community by sitting idly by while being exploited by what I call "prospectors," who come seeking riches in our ground without a care about the lasting consequences.

The biggest problem with the rezoning request is it's not a land use classification found anywhere else in the single family residential part of our community. This would open the door to exploitative development over which the community will have no clout, if we idy let this slip by without weighing-in."_ Alexander Levy

Just a "Thank You" to all that attended the NPU-W LUZ meeting tonight! There was a substantial presence there to represent our neighborhood. The developer's attorney "ratchet-jawed" most of the last 1hr45min of the meeting and it's looking like the developer is drilling a "dry hole". Especially after getting their butts handed to them by two of our neighbor's pointed questions that they had no retort for. The longer the Q&A went on, the more aggravated they became.
They are talking about building 20 houses with a 880 sq ft footprint on Thress (which is a private street). Can you imagine what a "cluster" that will be, trafficwise, trying to get in and out of the subdivision as the only access is Shadowridge.
They kept thumping their chests that they were only developing 50% of the property and "giving" the remainder to the City of Atlanta for a greenspace with trails. BS! What they are donating is property that they can't build on due to the steep and unusable terrain!
And the cpper is that the paperwork was not in order, so no vote to approve/disapprove could be taken!
