I am writing an article on property tax appeals 1) to advise taxpayers of the recent changes in GA law and 2) to answer common questions relating to the process.  But since I deal with this every day, I tend to lose sight of the everyday questions folks may have.

So, if you have any questions about why you should appeal, how it works, what to do, etc, please post here.  I will answer them, and also address the common questions in my article. 

To me, the biggest question would be "my value is fine (or low), why should I appeal?"  The answer is that there has been a statewide moratorium on raising taxes since 2008.  That expires after 2011.  So next year expect big increases in valuations as counties recoup shortfalls in revenue.  If you appeal, even if you do not get a reduction, the county cannot raise your value until 2014.  To me, that alone is reason enough to appeal.  I would not wait for the county to raise my taxes before appealing, when I can take a simple step to prevent any increase for three more years.

Well, holy crap, I had no idea about the taxes going up next year unless you appeal.
How does one appeal?

Is the moratorium on millage rates, or on property valuation?  I can't imagine in this housing market that they could reasonably increase the value of properties...

Is there still time to do it this year, in City of Atlanta/DeKalb, for example?

We just bought our house last year, and got a rebate against our escrow.  If we appeal will we have to give the money back?

Fawkes - you will get a Notice of Assessment sometime before July 1.  File a written appeal with the board of assessors once you get it. 

Gmoney - property valuation.  And reasonable never comes into play in property taxes.

SteveD - plenty of time.  The notice of assessment has not gone out yet, and you have 45 days after that to appeal.  Look for them sometime in the next month or so (must go out before July 1)

Esrik - I do not understand your question.

Awesome info to know ODB.  A tax appeal would not work on an investment property would it?  ie not primary residence....

you put money into escrow each month to cover your tax bill.  This year the bill was lower than the bank estimated, so they refunded the excess escrow and likely lowered the amount you put in each month.

if your tax stays about the same, then next year you get no refund
if your tax goes down again, then you might get another refund and adjustment
if your tax goes up next year, then you'll be asked to pony up the difference not covered by the amount in escrow and they will bump up your payment for the next year.

Gentri - there are no different rules for appealing an investment property.  Caveat - if you own $1million or over in an investment property, you can elect to have your appeal heard by a "hearing officer" instead of the BOE, which is new for 2011.  By all means, file an appeal if its investment property.

If you live in Fulton and just got your notice, you will see that the estimated amount owed is incredibly high.  I suspect that will probably be fixed when the actual bills go out, but who knows.  I encourage everyone to appeal.  Hell, if 5% of the total parcels are under appeal, then Fulton cant get their tax digest certified by the State.

It'll be real interesting to see how this all plays out. The moratorium happening from 2008-2011 makes for the worst possible timing for the counties. I can't imagine any piece of property is worth more now than then, but as Mr. Bastard says, that means little to "the process".

And thanks for bringing it up and advancing the knowledge. In normal times most people have no idea what they should do and it's much murkier now.

I love how the WSB story and this one from WXIA have Fulton officials laying the blame on computers:

If Fulton County actually has computers which fail to calculate properly, they've got big problems. I think it's far more likely that humans did not tell the computers to calculate the right things.
